On November 5, 2021, OSHA released its Emergency Temporary Standard (ETS) requiring most U.S. employers with 100 or more employees to adopt a COVID-19 vaccination policy with the option of including a weekly testing option. The original compliance dates for the various portions of the ETS were December 5, 2021, and January 4, 2022, but a number of legal challenges have put the ETS on hold and called into question whether it will survive.
