Legal Issues to Consider regarding COVID-19 Mandatory Vaccine Policies

This document from the National Restaurant Association Law Center addresses the legal questions that could be raised if a restaurant wishes to mandate the COVID-19 vaccine as a condition of employment.

The National Restaurant Association also confirmed, through the CDC, that many restaurant workers fit the criteria required to receive the Pfizer booster, based on their original guidance, see here. While restaurant workers are not specifically listed as an occupation of increased exposure, they do list food and agricultural workers and they have expressed that restaurant workers would fit the criteria. Additionally, a recent CDC presentation explained that higher-risk workers included people who interacted within 6 feet of other people. A CDC spokesperson said people would self-identify as qualifying for a booster under the new guidelines, especially considering they work in indoor spaces, in close proximity to others, and are unable to avoid frequent interactions with potentially unvaccinated people. Boosters from Moderna and J&J are still seeking FDA approval.

 

Also on the federal level, the Biden administration is attempting to mandate that employers with 100 or more employees must require employees to be vaccinated or provide weekly testing in place of vaccination. The National Restaurant Association sent a letter to the White House in opposition of the rule asking them to take into account the unique nature of our industry that is still very much recovering and facing a staffing crisis. This is a priority of the administration, and this will likely move quickly. We will share more information as this develops.

Vaccines are readily available in this region and now without appointment. DC Walk-up Clinics; VA Walk-up Site: Tysons; MD Walk-Up Sites

And in all jurisdictions, vaccine appointments are still available at https://vaccinefinder.org/ via pharmacies, clinics, and physicians. 

A reminder, Uber is offering free rides to and from vaccine appointments for restaurant employees in DC, MD, and VA. Click here to register your restaurant or foodservice operation.

Beginning on Saturday, May 1, the District will transition to the use of 11 high-capacity, walk-up, no appointment needed vaccination sites.*

The walk-up sites will be in addition to the pharmacies, clinics, and health care providers that are also administering the vaccines citywide. These sites will operate their own scheduling systems.  Walk ups are for ages 18 & over.

* Walk-up sites are for first doses. When you receive your first dose, you will still make an appointment to get your second dose. More information is available at vaccinefinder.org

Wednesday, April 28 is the last day pre registrations will be accepted through vaccinate.dc.gov

Every resident 16 or 17 can register at childrensnational.org.  Only 1 vaccine is approved for this age.

DC waiting on final guidance for Johnson & Johnson vaccine.

 

Additionally, the City is encouraging that anyone in DC can now make a vaccine appointment directly through the CVS website. Click here to see appointments. Previously, CVS appointments were limited to healthcare workers, seniors, and teachers.

Effective today Maryland to resume Johnson & Johnson COVID-19 Vaccine.

MD supports reintroduction, provider allowed to resume.

In Maryland officials are also taking steps to reach communities that need more accessibility and support. Maryland announced that several mass vaccination sites have walk-up access for people to get vaccinated without an appointment. Learn more here.

MD is also enhancing the capabilities of our state call center, which is assisting Marylanders who need help getting a vaccine, particularly those who are homebound or who need transportation or technology assistance.  Vaccine Support Call Center - Available seven days a week from 7 AM to 10 PM.  1-855-MD-GOVAX.

The Prince George's County Health Department is currently in Phase 3:

  • Anyone 16 and older who lives or works in Prince George's County is now eligible for vaccination.

  • Seniors and individuals with underlying medical conditions that increase their risk for severe COVID-19 illness will continue to be prioritized for appointments.

Site at Greenbelt Metro Station Now Open

Governor Larry Hogan and Prince George’s County Executive Angela Alsobrooks today announced that FEMA has agreed to open a community vaccination center in Prince George’s County beginning next week.

Site at Greenbelt Metro Station Now Open - As more vaccine doses become available, the center’s capacity is expected to be up to 3,000 shots per day. This will be the first federally-operated site in Maryland, and it will utilize direct vaccine allocations from the federal government.

The Six Flags COVID-19 vaccination site in Prince George’s County is operated by the State of Maryland and it is open to any eligible Marylander.

NORTHERN VIRGINIA

In Virginia officials are taking steps to reach communities that need more accessibility and support.

On 4/19/21, a new Metro-accessible mass vaccination site opened in Tysons Virginia in the former Lord & Taylor store at Tysons Corner Center. It is open and administers 3,000 vaccines per day, Monday through Saturday, by appointment only at vaccinefinder.org

On 4/18/21, Virginia moved forward to make all adults 16 years and older eligible for a vaccine.

Arlington County partnered with Amazon and our friends at JBG SMITH to open up a new vaccination clinic in National Landing at 2100 Crystal Drive next to some of Amazon's HQ2 office space. Appointments must be booked through the statewide pre-registration system

NOTE: Vaccines for individuals and eligible essential worker groups will be distributed in parallel.

NOTE: The vaccines have not yet been studied in children younger than 16. They will not be available to that age group until more information is available.

What You Need to Know About Vaccination Locations in the Fairfax Health District

As the allocation of COVID-19 vaccines from the Virginia Department of Health continues to increase, the Fairfax County Health Department has been working diligently to ensure that we are administering these vaccines as quickly as possible.
