ReOpening
On Wednesday, January 27th, Governor Northam announced that he has approved a permanent version of its COVID-19 workplace safety rules, which mandates employers implement pandemic precautions such as social distancing and masks. The permanent standards will remain in place at least until the end of the pandemic, at which point the Commonwealth’s Safety and Health Codes Board can reconvene to determine whether the regulations are still necessary. Employers should familiarize themselves with the new standard which is attached to this memorandum.

In Virginia, Governor Northam announced the expansion of the Rebuild VA grant program to help small businesses and nonprofit organizations affected by the COVID-19 pandemic. The eligibility criteria has been expanded and the amount of grant money businesses receive has increased. Governor Northam is directing an additional $30 million to support the expansion of the program. Businesses with less than $10 million in gross revenue or fewer than 250 employees will be eligible under the new criteria, and the maximum grant award will increase from $10,000 to $100,000. Rebuild VA funding may be utilized for the following eligible expenses:

Payroll support, including paid sick, medical, or family leave, and costs related to the continuation of group health care benefits during those periods of leave;

Employee salaries;
-
Mortgage payments, rent, and utilities;
-
Principal and interest payments for any business loans from national or state-chartered banking, savings and loan institutions, or credit unions, that were incurred before or during the emergency;

Eligible personal protective equipment, cleaning and disinfecting materials, or other working capital needed to address COVID-19 response.

- Per Amended Executive Order 67, restaurants and beverage services may operate with extra precautions in place to protect people from COVID-19 transmission. Private Events
As you continue to find new ways to reimagine your businesses models, we have received many questions regarding private events and how space may be utilized in safe and compliant ways. As of August 11th, in Virginia, social gatherings should be limited to 50% occupancy of the event space or 250 participants, whichever is less. Limit the occupancy of spaces to ensure that six feet of physical distance can be maintained between all organizers, staff, volunteers, and attendees who are not members of the same household, and reconfigure seating areas to allow six feet of physical distance between individuals.
